Welcome to our site. We maintain this web site as a service to our customers and visitors. By using our site, you are agreeing to comply with and be bound by the following terms of use. Please review the following terms carefully. If you do not agree to these terms, you should not review information or obtain goods or products from this site.
COPYRIGHT. The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such matters or any part of the Site, except as allowed by Section 4, is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through the Site. The posting of information or materials on the Site does not constitute a waiver of any right in such information and materials.
LIMITED RIGHT TO USE. The viewing, printing or downloading of any content, graphic, form or document from the Site grants you only a limited, nonexclusive license for use solely by you for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works or other use. No part of any content, form or document may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical, other than for your personal use (but not for resale or redistribution).
EDITING, DELETING AND MODIFICATION. We reserve the right in our sole discretion to edit or delete any documents, information or other content appearing on the Site.
NON-TRANSFERABLE. Your right to use the Site is not transferable. Any password or right given to you to obtain information or documents is not transferable.
DISCLAIMER AND LIMITS. The information from or through the site are provided "as available," and all warranties, express or implied, are disclaimed (including but not limited to the disclaimer of any implied warranties of merchantability and fitness for a particular purpose). The information and services may contain bugs, errors, problems or other limitations. We and our affiliated parties have no liability whatsoever for your use of any information or service. In particular, but not as a limitation thereof, we and our affiliated parties are not liable for any indirect, special, incidental or consequential damages (including damages for loss of business, loss of profits, litigation, or the like), whether based on breach of contract, breach of warranty, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages. The negation of damages set forth above are fundamental elements of the basis of the bargain between us and you. This site and the information would not be provided without such limitations. No advice or information, whether oral or written, obtained by you from us through the site shall create any warranty, representation or guarantee not expressly stated in this agreement. All responsibility or liability for any damages caused by viruses contained within the electronic file containing the form or document is disclaimed. We will not be liable to you for any incidental, special or consequential damages of any kind that may result from use of or inability to use our site. Our maximum liability to you under all circumstances will be equal to the purchase price you pay for any goods, services or information.
USE OF INFORMATION. We reserve the right, and you authorize us, to the use and assignment of all information regarding site uses by you and all information provided by you in any manner consistent with our privacy policy.
PAYMENT TERMS: All orders are sent C.O.D., money order or a major credit card, unless prearranged credit has been established, to allow for payment via a personal check. Credit may not be requested to Basic Choice Inc..
MINIMUM CHARGE: Minimum invoice is $8.00 net, which includes freight charges. On orders which do not meet the minimum invoice value, the quantity of items on the order will be increased to meet the $8.00 net amount where appropriate or a minimum order charge will be applied.
CREDIT TERMS: Terms of 2% ten (10) days or net thirty (30) days from the date of invoice are available. Accounts not paid within thirty (30) days of the date of the invoice will be considered past due with interest accruing at 2% per month being assessed. An order received on a past due (over 45 days) account will not be processed until the account is current. An account remaining unpaid sixty (60) days after the date of invoice may be referred for collection and credit will be cancelled.
FREIGHT: All goods are pre-paid by purchaser or invoiced F.O.B. our plant. When delivered to the transportation company, the shipments become property of the purchaser, who assumes the risk of loss or damage in transit.
RETURNED GOODS: Any defects or errors for which we are responsible will be promptly rectified. An ARI (authorization to return for inspection) must be obtained from Basic Choice Inc. Customer Service before any merchandise can be returned. Upon inspection of a product a decision will be made to repair or replace the product, or issue a credit for the product. It should not be assumed that credit will automatically be issued for a returned product. This decision will be made solely by Basic Choice Inc. in accordance with the provisions set forth in this instrument.
TRANSPORTATION CHARGES AND INSURANCE OF ALL RETURNED GOODS MUST BE PREPAID BY CUSTOMER. A 25% handling charge will be made on goods returned for customer convenience. When merchandise is returned for customer's convenience and upon buyer's compliance with all other provisions of this instrument regarding the return of merchandise and receipt of such returned merchandise by Basic Choice Inc. at the Customer Service facility, buyer will be issued a credit for 75% of purchase price. In no event shall the purchase price or any portion thereof be refunded to buyer. A refurbishing charge may be deducted to make returned good resalable. Goods which have been in the customer's possession for over 30 days will not be accepted for return or credit.
CANCELLATIONS: A charge of $25 will apply in addition to any cost incurred by Basic Choice Inc. for any cancellation made after our acknowledgment is issued.
DELIVERY: Delivery is contingent upon conditions at time of order and is subject to change. Under no circumstances shall Basic Choice Inc. be liable or accountable for consequential damages due to untimely delivery. Purchase Orders, Quotation Requests or Acknowledgments which have clauses contrary to these standard terms and conditions are not binding to Basic Choice Inc. unless such clauses are specifically approved in a separate written agreement by an officer of Basic Choice Inc.. In the event of an acceptance of buyer's purchase order, the buyer agrees that such acceptance shall be expressly conditioned on the terms and conditions set forth in this instrument. This instrument shall constitute the entire contract between Basic Choice Inc. and the buyer. We expressly reserve the right to correct clerical, stenographic, and other obvious errors at any time.
LIMITED WARRANTY: We assume no responsibility for delays, losses or damages to goods in transit. We must be promptly advised of any defective material. Sales are final except for replacements or credits. Claims for shortages or improper fulfillment of orders must be made within two weeks of delivery. We are not responsible for damage caused by use of your equipment.
PRIVACY POLICY. Our Privacy Policy, as it may change from time to time, is a part of this Agreement.
LINKS TO OTHER WEB SITES. The Site contains links to other Web sites. We are not responsible for the content, accuracy or opinions express in such Web sites, and such Web sites are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked Web site on our Site does not imply approval or endorsement of the linked Web site by us. If you decide to leave our Site and access these third-party sites, you do so at your own risk.
